Terms of Service

GENERAL INFORMATIONAny use of my work for/by AI or for NFTs are prohibited.You must be 18+ to commission me, even for SFW requests.
NSFW commissions must provide a date of birth during initial contact.
I reserve the right to decline a client for any reason, especially in regards to NSFW commissions. I will notify you as soon as possible if your commission is declined.Harassing, threatening, or insulting me will automatically cancel any approved commission with no refund. Depending on behaviour it will lead you to being blacklisted from commissioning me in the future.Please provide at least one Visual Reference. Multiple references are preferred, especially with a text description.For professional inquiries, studios, and projects, please email: [email protected]PAYMENTAny payment is non-refundable.
The accepted currency is US Dollars (USD).All commissions are required to pay 100% upfront or 50% upfront and 50% after approval of the sketch.All official payments for commissions must be made through a Paypal Invoice sent by MercyArt. Any compensation not made via this invoice will be considered a donation. Payments made to Patreon do not substantiate a commission request.Once the Invoice as been sent to the client, payment must be received within 7 days.
If extenuating circumstances arise, the client must notify the artist as soon as possible to pause and save their request until a later date.PROCESSI will start working on the commission after receiving at least 50% upfront.Progress shots are available upon request. A sketch will be sent for approval to the client. During this time the commission will be on hold pending discussion between Artist and Client.I will periodically reach out to the client for review after the sketch has been approved. The client will be responsible for responding to these communications or risk delaying their commission.If the client will not approve the sketch within 30 days or cuts contact with the artist, the commission will be terminated, and payment will not be refunded.Major Revisions are limited to 3 per commission. I reserve the right to decline any additional revisions, or revisions that cross legal or ethical boundaries.Once the Sketch is approved (either finishing the commission or moving onto the finishing stage), no additional major revisions can be requested.The finished piece will be completed and digitally sent to the commissioner via e-mail unless agreed otherwise. The commissioner has the right to request a JPG or PNG format, or a smaller file version of the finished work. If another file format is absolutely necessary, please let me know in advance.No PSDs or Clip files will be sent to any client/commissioner.TURNAROUND TIMETurnaround times can vary, but most commissions will be completed within 3 months of recieving the full payment.If the commission has a deadline or is a rush order, I must be notified when discussing accepting the commission with the client. Depending on how strict the deadline is, or if the Client requests a rush after the commission has begun, there will be an additional fee. This fee will be proportional to the timeframe, and negotiated with each client on a case-per-case basis.There is a chance I will experience personal circumstances such as illness, loss of required technology, etc. that means a commission will not be completed within the 3-month grace period. In such circumstances I will reach out to all approved clients/commissions and discuss revised timeframes or prorated refunds based on work completed.USAGE RIGHTSAll clients retain personal use rights over a completed commission, not commercial.These Personal use rights include but are not limited to:
Sharing the completed work on social media with proper credit to the artist (MercyArt).
Claim ownership rights over their characters but not the specific artwork made by the artist (MercyArt).
Print the artwork for personal use.The Term 'proper credit' indicates linking any artist’s socials, tagging them or writing 'Art by @MercyArt' (bluesky) / 'Art by @MercyArtist' (X) in the post’s description.If the commission is for commercial use, or if you'd like to use a pre-existing commission for commercial use, the client must reach out to discuss and sign a new agreement and pay an additional charge. This charge may be a flat fee or royalties depending on the agreement.All Clients are forbidden from removing the watermark/signature and editing the finished piece unless agreed otherwise. Please reach out if you have any questions about this clause.I (MercyArt) also retain personal use rights over any completed artwork unless agreed upon in a commercial agreement.Notably, I will use any commissioned piece to promote myself on social media. The client will be credited on request, otherwise it will listed as an anonymous commission (default).
Clients can request a private commission for an additional fee.
